Mediation / Conciliation Services
IIAM Members or parties having IIAM Mediation or Med-Arb clause in their agreement, can initiate IIAM services for mediation/conciliation, on any dispute or difference arising out of the said agreement, by delivering a written request for mediation/conciliation to the other party or parties with copies to IIAM, accompanied by the appropriate registration fee as per IIAM Fee Schedule. Such request for mediation shall contain a brief self-explanatory statement of the nature of the dispute, the quantum in dispute (if any), the relief or remedy sought and nominating a mediator or mediators thought suitable. The party initiating the service shall file Form 107 with IIAM. IIAM shall initiate the requested services as per the IIAM Mediation Rules.
Parties having a contractual dispute, not being IIAM members or not having an IIAM Mediation or Med-Arb clause or having a general mediation clause in the agreement, or having a non-contractual dispute, can initiate IIAM Mediation service by submitting an agreement for mediation in Form 103 or 104 as the case may be, together with a dispute submission request in Form 105, accompanied by the appropriate registration fee as per IIAM Fee Schedule. IIAM shall initiate the requested services as per the IIAM Mediation Rules.
Any Party having a contractual dispute, not having an IIAM Mediation or Med-Arb clause or having a general mediation clause in the agreement, or having a non-contractual dispute, can initiate IIAM Mediation service by submitting a dispute submission request in Form 105, accompanied by the appropriate registration fee as per IIAM Fee Schedule. IIAM shall contact the opposite party and if agreeable, initiate the requested services as per the IIAM Mediation Rules.
Arbitration Services
IIAM Members or parties having IIAM Arbitration or Med-Arb clause in their agreement, can initiate IIAM services for arbitration, on any dispute or difference arising out of the said agreement, by filing with IIAM a properly completed Notice of arbitration in Form 106, accompanied by the appropriate filing fee (Small cause / Regular). IIAM after scrutinizing the Notice of arbitration, administratively opens a file, assigns a file number, and notifies the initiating party ("Claimant"). A Party, who files the Notice of arbitration with IIAM, after serving the copy to each Respondent, shall file along with the Notice of arbitration, proof of service. IIAM shall initiate the requested service as per the IIAM Arbitration Rules.
Parties having a contractual dispute, not being an IIAM member or not having an IIAM Arbitration or Med-Arb clause or having an ad-hoc arbitration clause in the agreement, or having a non-contractual dispute, can initiate IIAM Arbitration service by submitting an agreement for arbitration in Form 101 or 102 as the case may be, together with a dispute submission request in Form 105, accompanied by the appropriate filing fee (Small cause / Regular). IIAM shall initiate the requested services as per the IIAM Arbitration Rules.
IIAM Community Mediation Service
Any person having a dispute or a potential dispute can utilize the IIAM Community Mediation Service by approaching any Mediation Clinic and resolve the same through which individuals are empowered to work collaboratively to develop creative and mutually agreeable solutions to conflicts. The process can be initiated by filing Form 115, the Dispute Submission Form. The Resident Coordinator of the Clinic will initiate the process by giving an invitation to the opposite side and appointing a community mediator to initiate the mediation process. The process is purely voluntary and confidential.
Negotiation/Settlement Services
A party may approach IIAM for initiating negotiation or settlement process by giving application in Form 113 in case of negotiating disputes or in Form 114 in case of negotiating business deals, with the relevant details and documents as may be necessary. IIAM will conduct a feasibility study based on the information supplied and on discussion with the party, if so required. Thereafter for conducting negotiation or settlement conferences, the party shall execute an MOU with IIAM and remit the registration fee applicable. On successful completion of the negotiation the party shall remit the IIAM fee, which is based on mutual consensus. The cost of negotiation / settlement shall be based on the relevant fee schedule.
IIAM DPM Services
IIAM DPM Services like iCLA legal audit can be availed by becoming an IIAM member or by separate application.
IIAM Services & Facilities
Members or non-members can avail IIAM Services and Facilities for mediation, conciliation, arbitration, conference halls, training halls etc. by delivering a request in Form 112. IIAM shall offer the services based on scrutiny of the request and feasibility and based on the fee schedule.
